Welcome to Pylons! These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Pylons, LLC, a Wyoming limited liability company ("Pylons," "we," "us," or "our"). By accessing or using our AI agent infrastructure platform and related services (collectively, the "Services"), you agree to be bound by these Terms.
1. Introduction and Acceptance
By creating an account, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are accepting these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.
If you do not agree to these Terms, you must not access or use the Services.
2. Eligibility and Account Registration
2.1 Eligibility Requirements
To use the Services, you must:
- Be at least 18 years of age or the age of legal majority in your jurisdiction
- Have the legal capacity to enter into binding contracts
- Not be prohibited from using the Services under applicable law
- For business accounts: be authorized to bind your organization to these Terms
2.2 Account Registration
When creating an account, you agree to:
- Provide accurate, current, and complete registration information
- Maintain and promptly update your account information
- Maintain the confidentiality and security of your login credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized account access
2.3 Account Security
You are solely responsible for maintaining the security of your account credentials, including passwords and API keys. Pylons will not be liable for any loss or damage arising from your failure to maintain account security. We strongly recommend enabling multi-factor authentication (MFA) where available.
3. Description of Services
3.1 Platform Overview
Pylons provides a managed infrastructure platform for deploying, hosting, and managing AI agents. Our Services include:
- AI agent deployment and hosting infrastructure
- Compute resource allocation and management
- API access for agent integration
- Monitoring, logging, and analytics tools
- Security and compliance features
- Technical support and documentation
3.2 Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Services may be temporarily unavailable due to scheduled maintenance (with advance notice when possible), emergency maintenance, factors beyond our reasonable control, or actions required to protect the security or integrity of the platform.
3.3 Service Modifications
Pylons reserves the right to modify, update, or discontinue any aspect of the Services at any time. For material changes that may adversely affect your use, we will provide reasonable advance notice. Continued use after such changes constitutes acceptance.
4. Customer Responsibilities
4.1 Compliance Obligations
You are responsible for:
- Ensuring your use of the Services complies with all applicable laws and regulations
- Obtaining all necessary rights, consents, and permissions for data you process
- The actions of your AI agents and ensuring they operate within legal boundaries
- Implementing appropriate safeguards for sensitive data
- Monitoring your agents for compliance with these Terms
4.2 Customer Data
You retain all rights to your data ("Customer Data"). You grant Pylons a limited license to process Customer Data solely to provide and improve the Services. You are responsible for the accuracy, quality, and legality of Customer Data and the means by which you acquired it.
5. Acceptable Use Policy
5.1 Prohibited Uses
You may not use the Services to:
- Violate any applicable law, regulation, or third-party rights
- Deploy agents that engage in deceptive, fraudulent, or harmful activities
- Process or transmit malware, viruses, or malicious code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the Services or circumvent security measures
- Reverse engineer, decompile, or attempt to extract source code
- Use the Services to compete directly with Pylons
- Engage in cryptocurrency mining or similar resource-intensive activities without authorization
- Deploy agents that harass, threaten, or harm individuals
- Distribute illegal content or facilitate illegal transactions
5.2 Enforcement
Pylons reserves the right to investigate and take appropriate action against violations, including suspending or terminating accounts, removing content, and cooperating with law enforcement. We may implement rate limiting or other restrictions to prevent abuse.
6. Fees and Payment
6.1 Pricing
Current pricing is available on our pricing page. Fees may include subscription fees (monthly or annual), usage-based charges (compute, storage, API calls), and add-on services and features. All fees are in U.S. dollars unless otherwise specified.
6.2 Billing and Payment
Subscription fees are billed in advance. Usage-based fees are billed in arrears. Payments are processed through our third-party payment processor. You authorize us to charge your designated payment method for all applicable fees. You are responsible for providing accurate billing information and keeping it current.
6.3 Taxes
Fees are exclusive of applicable taxes, levies, or duties. You are responsible for paying all such taxes, except for taxes based on Pylons' income. If we are required to collect taxes, they will be added to your invoice.
6.4 Late Payment
Late payments may incur interest at 1.5% per month (or the maximum legal rate). We may suspend Services for accounts with overdue balances exceeding 30 days. You remain liable for all fees incurred during any suspension period.
6.5 Refunds
Fees are generally non-refundable. Refund requests will be considered on a case-by-case basis. Contact info@pylons.io for billing inquiries.
7. Intellectual Property
7.1 Pylons Property
Pylons retains all rights, title, and interest in the Services, including all software, technology, documentation, trademarks, and intellectual property. Nothing in these Terms grants you ownership rights in the Services.
7.2 Customer Property
You retain all rights to your Customer Data, AI agent configurations, custom code, and other materials you provide. You grant Pylons a limited, non-exclusive license to use such materials solely to provide the Services.
7.3 Feedback
If you provide suggestions, ideas, or feedback about the Services, you grant Pylons an unlimited, irrevocable, royalty-free license to use such feedback for any purpose without compensation or attribution.
8. Confidentiality
8.1 Confidential Information
"Confidential Information" means non-public information disclosed by either party that is designated as confidential or would reasonably be understood to be confidential. This includes Customer Data, pricing terms, business strategies, and technical specifications.
8.2 Obligations
Each party agrees to protect the other's Confidential Information using at least the same degree of care used to protect its own confidential information, but no less than reasonable care. Neither party will disclose the other's Confidential Information except to employees, contractors, or agents who need to know and are bound by confidentiality obligations.
8.3 Exceptions
Confidentiality obligations do not apply to information that is publicly known through no fault of the receiving party, rightfully known before disclosure, independently developed, or required to be disclosed by law (with reasonable notice to the disclosing party).
9. Privacy and Data Protection
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to our data practices as described in the Privacy Policy.
Where you process personal data through the Services, you act as the data controller and Pylons acts as data processor. You are responsible for ensuring appropriate legal bases for processing and providing required notices to data subjects.
10. Third-Party Services
The Services may integrate with or allow connections to third-party services, APIs, and platforms. Your use of such third-party services is governed by their respective terms and policies. Pylons is not responsible for third-party services, their availability, content, or practices.
You acknowledge that connecting third-party services may require sharing data with those services. You are responsible for reviewing and complying with third-party terms.
11. Disclaimers and Warranty Limitations
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PYLONS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
PYLONS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. PYLONS DOES NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY RESULTS OR OUTPUTS GENERATED BY YOUR AI AGENTS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
(a) IN NO EVENT WILL PYLONS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, REGARDLESS OF THE THEORY OF LIABILITY.
(b) PYLONS' TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF: (i) THE AMOUNTS PAID BY YOU TO PYLONS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (ii) ONE HUNDRED U.S. DOLLARS ($100).
(c) THESE LIMITATIONS APPLY EVEN IF PYLONS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF WHETHER ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
13. Indemnification
You agree to indemnify, defend, and hold harmless Pylons and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the Services or violation of these Terms
- Your Customer Data or AI agent configurations
- Actions taken by your AI agents
- Your violation of any third-party rights
- Any claims by your end users or customers
14. Term and Termination
14.1 Term
These Terms commence when you first access the Services and continue until terminated. Subscription terms renew automatically unless cancelled before the renewal date.
14.2 Termination by You
You may terminate your account at any time through your account settings or by contacting us at info@pylons.io. Termination does not entitle you to a refund of prepaid fees.
14.3 Termination by Pylons
Pylons may terminate or suspend your access immediately if you breach these Terms, fail to pay fees when due, engage in prohibited activities, or if required by law. We may also terminate for convenience with 30 days' notice.
14.4 Effect of Termination
Upon termination, your right to access the Services ends immediately. You may export your Customer Data for up to 30 days after termination. After this period, we may delete your data. Provisions that by their nature should survive termination will survive, including indemnification, limitation of liability, and dispute resolution.
15. Dispute Resolution
15.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of laws principles.
15.2 Informal Resolution
Before initiating formal dispute resolution, you agree to first contact us at info@pylons.io and attempt to resolve the dispute informally for at least 30 days.
15.3 Arbitration
Any dispute not resolved informally will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration will be conducted in Sheridan, Wyoming, before a single arbitrator. The arbitrator's decision will be final and binding.
15.4 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
15.5 Exceptions
Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information.
16. General Provisions
16.1 Entire Agreement
These Terms, together with the Privacy Policy and any applicable service agreements, constitute the entire agreement between you and Pylons regarding the Services, superseding all prior agreements.
16.2 Assignment
You may not assign or transfer these Terms without our prior written consent. Pylons may assign these Terms freely, including to an affiliate or in connection with a merger, acquisition, or sale of assets.
16.3 Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
16.4 Waiver
No waiver of any term will be deemed a further or continuing waiver. Pylons' failure to enforce any right or provision will not constitute a waiver of such right or provision.
16.5 Force Majeure
Neither party will be liable for delays or failures in performance resulting from circumstances beyond its reasonable control, including natural disasters, acts of government, pandemics, war, terrorism, or internet or telecommunications failures.

Notices to Pylons must be sent to info@pylons.io or by mail to 30 N Gould St Ste R, Sheridan, WY 82801. We may provide notices to you via email, in-app notifications, or posting on our website.

Appendix A: Beta and Preview Terms
The following additional terms apply to beta, preview, or early access features ("Beta Features"):
- No Warranties: Beta Features are provided "as is" without any warranty. They may contain bugs, errors, or other issues.
- Changes: Beta Features may be modified, suspended, or discontinued at any time without notice.
- No SLA: Service Level Agreements do not apply to Beta Features.
- Feedback: You agree to provide feedback about Beta Features upon request. All feedback becomes Pylons' property.
- Confidentiality: Beta Features may be confidential. You agree not to disclose information about Beta Features without our consent.
- Data: Data processed using Beta Features may be lost or corrupted. You are responsible for backing up your data.
- No Production Use: Unless explicitly authorized, Beta Features should not be used for production workloads.
Appendix B: Service Level Terms
For customers on paid plans, Pylons commits to the following service levels:
Uptime Commitment
Pylons targets 99.9% monthly uptime for production Services. "Uptime" means the Services are accessible and functioning materially as documented.
Exclusions
The uptime commitment excludes: scheduled maintenance (with 24-hour advance notice), Beta Features, issues caused by factors outside Pylons' control, issues caused by your equipment, software, or network connections, and your actions that violate these Terms.
Service Credits
If Pylons fails to meet the uptime commitment, you may be eligible for service credits:
- 99.0% - 99.9% uptime: 10% credit of monthly fees
- 95.0% - 99.0% uptime: 25% credit of monthly fees
- Below 95.0% uptime: 50% credit of monthly fees
Credit Request Process
To request a service credit, you must submit a request to info@pylons.io within 30 days of the incident. Include your account information and description of the downtime. Credits will be applied to future invoices and are not redeemable for cash.
Sole Remedy
Service credits are your sole and exclusive remedy for Pylons' failure to meet uptime commitments. The maximum total credit for any billing month is 50% of that month's fees.
